最近常听到在讲美国海关最近严查,有人被罚款等等的消息。比如

上面这些消息大部分都是道听途说的。我这里给大家提供一个实例,供大家分析。
先看看下面的那封海关没收通知的信。我把大概情况和大家介绍一下:
此人Richard Roe是我们的一个合作公司的人,他们公司和我们在北京有项目合作。所以他被派去北京和我们一起工作。因为是合作公司的人,所以我很好地招待了他们。我带他们去了许多“该去”和“不该去”的地方,包括秀水街。
海关的信里讲到的所没收的15 Handbags, 10 Wallets, 15 scarves, 70 ties, and 2 watches都是我带他在秀水街买的。加起来大概花了3000多元人民币。
15 DVD Movies是在大街上买的。
因为这哥们买的东西太多了,来的时候的一件行李箱装不下。所以就在秀水街买了一个中国产的行李箱,大概200元人民币。不是假冒的名牌,是浙江什么地方生产的。上面还有汉语的那种。质量很好,很结实。但是是明显的廉价中国货。(这是所犯的第一个错误。这个行李箱没被没收)。
他们(他们公司的两个人,都是白人)回美国的时候和我坐的不是同一个航空公司的飞机。入关的时候,他的老板没有被检查,他却被挑了出来检查。并把所有的中国买的东西没收了。但并没有罚款。一个星期以后海关给他来信了,正式通知他东西没收了。
我这次去加州。因为和他们是“哥们”,当时那些东西又是我带他们去买的,所以大家就拿这个事情当笑话说。他给我看了海关给他的信。我问了他一下大概的情况。
那天,他穿的十分CASUAL,JEAN、T-Shirt、拖鞋(这是所犯的第二个错误)。他老板穿的是Business Suit,没带领带。而且他老板没用中国产的行李箱。
他老板看去就是个老板,这哥们看上去就是个“玩主”,当然如果他穿上西装也是looks very good的。
从信上分析:
第一、如果只带的是假货,应该是不会被罚款的。因为海关讲We have reason to believe the merchandise bears counterfeit trademarks。但只是believe,你仍然可以obtain written authorization from the trademark holder来证明你没有带假货。所以如果要是罚款的话,万一你能证明你的东西不是假货,海关还要把罚款退回给你。
当然你是证明不了的,就算你能证明全是真货,那么海关给你算过帐了,你的东西the appraised domestic value of the merchandise is $12,790.00. 近一万三千美元的东西你要交多少关税啊?还不如让海关没收了算了。
第二、大家都在讲说有老中被罚了十几万,我想他是带了食物或其他东西而违反的美国海关的规定。属于违法事实认定很清楚。所以当场就可以罚款。
不知道这样讲对不对,请这里的律师朋友们也给分析分析。
最后严重声明一下,我写这些是给大家一个案例,让大家知道什么是违法,违法将会如何受到惩罚。绝没有鼓励大家违法的意思。如果我不声明,总有人弱智,认为我是在鼓励大家去欺骗海关。所以,尽管是废话,还是要说。讨论杀人案,并不是教唆读者去当杀人犯。

We have reason to believe the merchandise bears counterfeit "DVD and Design", "Dolby Digital and DD Design", "DTS Digital Surround", "Warners Brothers", "20th Century Fox", "Chanel", "Tommy Hilfiger", "Gucci", "Boss Hugo Boss", "Marithe & Francois Girbaud", "Hermes Faubourg Saint-Honore Paris", "Ferragamo", "Giorio Armani", "Burberry", "Louis Vuitton", "Fendissime", and "Franck Muller" trademarks as recorded under USCBP Recordation #'s 00-00247, 02-00928, 04-00150, 98-00233, 03-00841, 02-00743, 93-00725, 04-00243, 04-00246, 93-00429, 95-00323, 02-00193, 03-00065, -98-00054, 02-00776, 04-00365, 00-00543, 02-00901, and 97-00725. This merchandise is now subject to forfeiture for the United States Goverment.
The appraised domestic value of the merchandise is $12,790.00.
Section 618, Tarriff Act of 1930, as amended (19 USC 1618 ) provideds persons claiming an interest in seized property the privilege of filling a petition for the remission or mitigation of the liability for forfeiture of the seized property, provided that petition is filed within thirty (30) days from the date of this letter.
The subject merchandise cannot be released from Customs custody without you obtaining written authorization from the trademark holder. You must provide a copy of that authorizaiton with your petition.
The petition should describe all pertinent facts and circumstances in connection with the violations. The enclosed Notice of Seizure and Information for Claimants letter and the "WAIVER" form more fully describe your right to petition.
Under 19 CFR 171.11 (d), unless the petition provides an express agreement to defer administrative proceedings until the completion of the administrative process, the case will be referred promptl for initiation of forfeiture proceedings. The enclosed waiver form must be returned with your petition, within the allotted thirty days.
Your petition, addressed to the Fines, Penalties and Forfeitures, Officer of Customs should be forwarded to the U.S. Customs Services, P.O.Box 99999, XXXXX, XX 92222.
